4 17-12-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Makhdumpur P.S. Case No. 462 of 2018 registered for the offence punishable under Sections 341, 323, 324, 379 and 504/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioners herein having assaulted the informant and his family members resulting in injuries to the prosecution side. However, the main allegation is against the co-accused person, namely, Prem Shankar of having pelted brick and stones which

in fact has caused injuries on the person of the members of the prosecution side.

The learned counsel for the petitioners has submitted that the petitioners are innocent, they are having a clean antecedent and there is no specific allegation of any sort of overt act as against them.

Per contra, the learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 462 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
