The petitioners apprehend their arrest in Ara Town P.S. case No. 273 of 2019 registered under Section 147, 148, 149, 341, 323, 307, 379, 447, 504 of the IPC.

The informant named the petitioners and other accused persons and alleged that some scuffle took place due to parking of Thela between Krishna Mohan Yadav, petitioner No.1, and Raju Yadav, son of the informant. On the order of Krishna Mohan Yadav, Anup Yadav is said to assaulted Raju Yadav with iron rod on his head. When the informant came to save his son, Mukesh Yadav is said to have assaulted the informant with Lathi on his head. Guddu Yadav also came to save the informant and his son. Arvind Yadav assaulted Guddu

The learned counsel for the petitioners submits that Anup Yadav, Mukesh Yadav and Arvind Yadav are not the petitioners. There is no allegation of assault against the petitioners. The informant made allegation against Krishna Mohan Yadav that he gave order to assault the son of informant and others. Krishna Mohan Yadav is aged about 72 years. Sheoji Yadav, the informant, got four injuries but all injuries are simple in nature. The assailant of Sheoji Yadav is Mukesh Yadav. Guddu Yadav also got injuries but assailant of Guddu Yadav is Arvind Yadav. The assailant of Raju Yadav is Anup Yadav.

Taking into consideration the facts that no specific allegation of assault is made against the petitioners and on account of parking of Thela some dispute arose between two sides, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Town P.S. case No. 273 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
