Petitioner seeks bail in anticipation of his arrest in connection with Koilwar P.S. Case No. 242 of 2017, registered for the offences punishable under Sections 419/420/120-B the Indian Penal Code and under Section 7 of Essential Commodities Act.

Petitioner happens to be Assistant Godown Manager of B.S.F.C and as per F.I.R one truck was intercepted loaded with B.S.F.C. grains and petitioner has also been made accused in the case.

Submission of the learned counsel for the petitioner is that grains were loaded for the delivery at Sandesh to the dealer of Sandesh and on the way it was intercepted. There is no allegation against the petitioner who happens to be Assistant

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Koilwar P.S. Case No.-242 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that petitioner cooperate in the investigation and appear as and when required.
