3 03-12-2019 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners apprehend their arrest in connection with Uphara P.S. Case No. 01 of 2015 instituted for the offence under Section(s) 341, 323, 324, 307, 379/34 of the Indian Penal Code.
It is submitted by the petitioners’ counsel that they have been falsely implicated in the instant case and that the injury report also shows the nature of injury to be simple.
Learned APP for the State opposed the prayer for bail. It is submitted that the specific allegation of assault, by means of

‘ Farsa’, ‘Lathi’ and knife, made against the petitioners duly corroborated by the Medical Report (Annexure-3).
Considering the gravity of the allegations and the nature of the injuries caused over the scalp of the victim, this Court is not inclined to allow the privilege of anticipatory bail to the petitioners.
The prayer for anticipatory bail is, accordingly, rejected.
