This is an application for grant of anticipatory bail in connection with Gopalganj Town P. S. Case No. 254 of 2019, disclosing offences under Sections 406, 409, 34 of IPC.

As per F.I.R. allegation against the petitioner is that informant was running a Poly House which was constructed by the agency on the land of the petitioner, but later on, the demand of the house was not constructed over the land.

Submission of the learned counsel for the petitioner is that the agency was working as per the instruction given by the authority. He has constructed the same, but later on, same was damaged and a Poly house is still found there. Petitioner is only beneficiary and the co-accused, who is running the agency, has been granted privilege of anticipatory bail by a Co-ordinate

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Gopalganj, in connection with Gopalganj Town P. S. Case No. 254 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
