Petitioners seek bail in connection with Falka (Pothiya) P.S. Case No. 367 of 2018 registered for the offence punishable under sections 376, 302 and 201 of the Indian Penal Code and Section 4 of the POCSO Act.

Learned counsel appearing for the petitioners submits that the first information report is lodged against unknown. Petitioners have been implicated in this case on basis of confessional statement of the co-accused. The said co-accused Deepak Kumar Sharma, on whose confessional statement, these petitioners have been implicated in the

present case, has been granted bail by a co-ordinate Bench of this Court vide Annexure-2. Petitioners have no criminal antecedent and are in custody since 16.08.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1^st Additional Sessions Judge-cum-Special Judge, POCSO, Katihar in connection with Falka (Pothiya) P.S. Case No. 367 of 2018.
