Petitioner seeks bail in anticipation of her arrest in connection with Bagaha P.S. Case No. 294 of 2018 registered for the offences punishable under Sections 341, 323, 387, 406, 420, 467, 471 and 34 of the Indian Penal Code.

Prosecution case as per FIR is that the father of the informant has purchased 4 bigha 4 katha and 9 dhurs of land from the petitioner in the year 1972 through registered sale deed and since then he was in possession over the land and also got the land mutated but later on the petitioner has executed a forged sale deed in favour of other accused persons and on the basis of which they are trying to grab the land and also demanding Rs.10 lacs from the informant as extortion.

Submission of learned counsel for the petitioner is that she is owner of the big chunk of the land, out of which she sold some land to the father of informant and later on she sold some land to

other persons but the land is not the same. Moreover, petitioner is an old lady and is hospitalised due to her illness and the story of demand of extortion is not made out against the petitioner.

Heard learned APP and learned counsel for the informant,

who has opposed the prayer for anticipatory bail.

In view of above facts and circumstances and also considering the age of the petitioner, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, District West Champaran, in connection with Bagaha P.S. Case No. 294 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required.
