Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 356 of 2012, registered under Section 7 of the E.C. Act, 1955 read with Section 34 of the Indian Penal Code.
The accusation is of selling the LPG Gas cylinder in black market by the Manager and staff of M/S S.R. Enterprises, Gaya.
Learned counsel for the petitioner submits that petitioner is the partner of 35% in M/S S.R. Enterprises, Gaya and Smt. Sushila Devi is the partner of 65% and the management and work of M/S S.R. Enterprises, Gaya, is being

looked by Smt. Sushila Devi and petitioner has no role in management of M/S S.R. Enterprises, Gaya. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 356 of 2012 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
