A mobile phone was recovered by the police from co-
accused Monu Yadav and Monu Yadav disclosed that he had purchased the same from this petitioner.
Considering the submission of the petitioner that only confessional statement of co-accused is there against the petitioner which is no evidence in the eye of law, a Bench of this Court had granted provisional bail and had called for case-diary. The case-diary also does not contain anything more than the aforesaid.
Hence, let the provisional bail granted to the
Patna High Court CR. MISC. No.61295 of 2019(4) dt.06-12-2019 2/2
petitioner in connection with Durgawati P.S. Case No.222 of 2019 be confirmed.
