The petitioners apprehend their arrest for the offences alleged under Sections 384 of the Indian Penal Code and Section 7(a) of the Prevention of Corruption Act, 1988 registered in connection with Jagdishpur P.S. Case No. 239 of 2019.

It is submitted that the petitioners have been falsely implicated on the accusation of accepting illegal gratification for passing vehicles on the basis of a video gone viral. It is submitted that even though the petitioners along with other officials were on duty as evident from the report of the Excise Inspector, Bhagalpur (Annexure-P/2), they have not indulged in any illegal act. Pursuant to show cause notices being issued they have expressed ignorance about the incident involving acceptance of illegal gratification. The petitioners claim clean antecedents.

Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed.

If the petitioners surrender and seek regular bail before the learned Court below the same shall be considered on its own merit in accordance with law and without being prejudiced by any observation in the present order.
