Petitioners seek bail in anticipation of their arrest in connection with Madhuban P.S. Case No. 123 of 2016 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code.

As per FIR there is allegation against the petitioner that they provoked the son of the informant to climb on electric pole and his son fell down and died by electric shock.

Submission of learned counsel for the petitioners is that the allegation is false and concocted and material has come in the case diary that there was some disconnection of electricity and when electricity came all of a sudden he got electrocuted

and petitioners had no role and they are ready to abide by any condition that may be imposed on them and there is no chance of tampering with the evidence.

In view of above facts and circumstances, let petitioners, in the event of surrender within a period of three weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, East Champaran, Motihari, in connection with Madhuban P.S. Case No. 123 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
