2 18-09-2019 Petitioner seeks bail in anticipation of his arrest in

connection with Complaint Case No. C 347 of 2017 instituted for the offences punishable under Sections 465, 468 and 120B of the Indian Penal Code.

Prosecution case as per complaint petition is that the petitioner has not returned the share of land of the complainant and on protest the petitioner abused him and assaulted him. There is also allegation that when wife of complainant went to save the complainant they snatched her cloth and made her naked and also snatched silver chain and payal.

Submission of learned counsel for the petitioner is that as a matter of fact petitioner got his share of the land of the

complainant in Badlen and thereafter he sold the land, which will appear from Annexure-2 and moreover the matter is in the nature of civil dispute between the parties.

In view of above facts and circumstances, let petitioner surrender in the court below within a period of two weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Das, Judicial Magistrate, 1^st Class, Kishanganj, in connection with Complaint Case No. C 347 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of complaint case and appear in court as and when required.
