Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 251 of 2019, registered under Sections 30(a) and 41(a) of the Bihar Excise Act.

The accusation is that on receiving secret information about unloading of illicit liquor in the orchard in village New Pandsrai, the informant along with other police personnel reached near the orchard then saw that several persons were unloading the cartoons. On seeing the police party, the persons, who were unloading the cartoons of liquor, succeeded to flee away but the Choukidar identified nine persons named in the FIR including the petitioner, who succeeded to flee away. On search, 11 cartoons containing 264 bottles of 375 ml Indian made foreign liquor were

recovered from the Bolero Pickup van and 10 cartoons containing 240 bottles of 375 ml Indian made foreign liquor nereby the Bolero Pickup van.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather petitioner and eight others are said to be identified by the local Choukidar due to dirty village politics, in fact, petitioner is not the owner of seized vehicles. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge-II-cum-Special Judge Excise, Darbhanga, in connection with Bahadurpur P.S. Case No. 251 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
