Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 30(a)(b)(c) of the Bihar Prohibition and Excise Act.

Submission is that liquor was recovered from the river side and not from the physical possession of the petitioners. However, petitioners were apprehended on suspicion while they were fleeing from that place. Petitioners have stated on oath that they have got no criminal antecedent.

Considering the facts aforesaid, let the petitioners,

above named, be released on bail after completion of investigation on furnishing bail bonds of Rs.20,000/- (Rupees

Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Excise Case No.1324 of 2019, arising out of Tarari Police Station Case No.123 of 2019 , subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners .
