Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. It is further submitted that the alleged recovery of 34 litres of country made liquor has been made from a plastic bag kept on red colour Hero Honda Splendor Motorcycle having Registration No. BR 01A 2233, the petitioner has nothing to do with the said motorcycle. Petitioner has got no criminal antecedent and he is a welder and for his livelihood he used to

work in foreign country from where he had recently came. Petitioner is in judicial custody since 21.07.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IIcum-Special Judge, Excise, Gopalganj in connection with Yadopur Police Station Case No. 76 of 2019.
