The petitioner is in custody in connection with Siwaipatti P.S. Case No. 46 of 2019 for the offenses under Sections 30, 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016 and 272, 273, 120B/34 IPC.

In the instant case 921.765 liters of liquor is alleged to have been recovered.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 11.06.2019.

Considering the fact that the petitioner has no criminal antecedent the Court is inclined to grant bail to the petitioner but having regard to the quantity of liquor alleged to

have been seized, the Court is of the view that the petitioner should be saddled with stringient condition. Accordingly, the court below is directed to release the petitioner, above named, on bail on furnishing bail bond of Rs. 25,000/-(Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Muzaffarpur in connection with Siwaipatti P.S. Case No. 46 of 2019 subject to deposit of Rs. 50,000/- cash in the court below.

The deposit of cash of Rs. 50,000/- shall abide by the final out come of the pending criminal case.
