Prosecution case, in short, is that the motorcycle of the informant, parked at the bathan of Bhrigun Yadav, was found missing.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.06.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Stolen motorcycle is alleged to have been recovered. The petitioner had no knowledge that the motorcycle in question is stolen property. He has been made accused due to mistake of fact.
