Heard learned counsel for the petitioners and learned

counsel appearing on behalf of the State.

Petitioners apprehend their his arrest in connection with Sasaram Nagar P.S. Case No.22 of 2019 for the offence punishable under Sections 341, 323, 384, 379, 504, 506, 34 of the Indian Penal Code and Section 27 of Arms Act.

The allegation against the petitioners is that petitioners along with other accused persons stopped the work of PCC road constructed by the informant and abused nephew

and brother of the informant and told that if demand made by the petitioners were not fulfilled, the petitioners would not allow the work to continue. It has further been alleged that Anil Yadav assaulted the brother of the informant by means of butt of rifle and accused persons snatched golden chain etc.

Mr. Vikramadeo Singh, learned counsel for the petitioners submits that there is no specific allegation against the petitioners of assault and nobody has got injuries due to the firing made by other co-accused persons. He further submits that informant being contractor was constructing the PCC road with sub-standard materials and upon protest being made by the petitioners, present complaint has been filed in order to pressurize the petitioners by the informant.

After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that there is no specific allegation against the petitioners and nobody has got injury pursuant to the firing made by other co-accused persons, as such, I am inclined to grant anticipatory bail to all these petitioners.

Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a

period of four weeks from today and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sasaram, Distt.-Rohtas, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
