This application, for grant of anticipatory bail, arises out of Baikunthpur P.S. Case No. 89/2019, disclosing offences under Sections 341, 323, 379, 307, 384, 504/34 of the Indian Penal Code.

Prosecution story as per written report of the informant is that petitioner no. 1 was stealing the materials, which were kept for construction of road and when the informant reached there, they demanded rangdari of Rs. 20,000/-. Further allegation is that in the evening when the

informant went to the market came and assaulted him by emans of rod, knife, lathi, fists and slaps and specific allegation against petitioner no. 2 that he assaulted on the head of informant by means of rod and against petitioner no. 1 is that he assaulted by means of knife on his shoulder and further there is also allegation of snatching cash and ornaments.

Submission of learned counsel for the petitioners is that out and out false and fabricated allegation has been levelled by the informant and the real fact is that when the petitioners objected the use of inferior materials in construction of road, an altercation between the parties took place and for that a case has been lodged by the petitioner no. 1 against the informant and due to which, the informant came out with this false case and no such occurrence as alleged by the informant has ever taken place and although there is allegation against the petitioners is of assaulting the informant but injuries are found to be simple in nature.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of
