Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Matihani P. S. Case No 02 of 2019 instituted for the offence under Section(s) 25(1-b)a, 26 and 35 of the Arms Act and Section 414 of the IPC.

Learned counsel for petitioner submits that the recovery of the firearms as mentioned in the seizure list is from co-accused Fekan Kumar. Petitioner has been made accused only because he was also sleeping with Fekan Kumar in the house and was apprehended by the police. Seizure list is part of the FIR. From perusal of the Seizure list, it appears that recovery of firearms have been made from possession of coaccused Fekan Kumar. There is no recovery of any firearms

from possession of this petitioner.

Petitioner is in custody since 8.1.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1^st Class, Begusarai, in connection with Matihani P. S. Case No 02 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
