Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Hathuwa P. S. Case No 167 of 2018 instituted for the offence under Section(s) 376/511 of the Indian Penal Code.

Learned counsel for petitioner submits that instant case has been filed due to pattidari dispute and much prior to this case petitioner had filed Hathuwa P.S. case no. 171 of 2017 against the informant Uma Devi and her husband and others.

In the instant case there is general and omnibus allegation that on the date of occurrence the petitioner tried to outrage the modesty of informant after entering into her house.

Petitioner is in custody since 3.4.2019

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Gopalganj, in connection with Hathuwa P. S. Case No 167 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
