A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dehri (Town) P.S. Case No. 473 of 2014, registered for the offence punishable under Section 379 of the Indian Penal Code.

275 mounted dustbins worth Rs.42,65,500/- is said to have been stolen from the premises of the Nagar Parishad, Dehri by unknown miscreants.

It is submitted by learned counsel for the petitioner that he has no concern with the aforesaid occurrence. He has been falsely implicated in this case during course of investigation. As a matter of fact, he happens to be staff of Reliable Enterprises who had sold the aforesaid dustbins to the

Parishad to be placed at different places. On the instruction of his owner namely Rishu Shri in the presence of the Junior Engineer of the Parishad namely Lawkush Singh he facilitated the loading of the said dustbins on the truck brought in the premises by Chinmay Priya @ Vicky, Bablu, Sanjeev and Rakesh in the presence of gatekeeper Budhu Ram. He has no knowledge of whereabout of aforesaid dustbins after getting the same loaded on the truck. Aforesaid Budhu Ram has filed petition before the police after four months of the aforesaid occurrence. During the course of preliminary inquiry conducted by the Parishad S.D.O. has found complicity of the staff of the Parishad and supplier of the dustbins in the occurrence. No incriminating article has been recovered from the conscious physical possession of the petitioner. Owner of the Reliable Enterprises namely Rishu Shri has been enlarged on anticipatory bail by a co-ordinate Bench of this Court and said Junior Engineer has been enlarged on anticipatory bail by learned lower Court. He has no criminal antecedent.

On the other hand, learned A.P.P. for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the

event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub- Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (T) P.S. Case No.473 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
