Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered under Sections 452, 323, 354, 380, 504 and 506 of the Indian Penal Code.

Petitioner along with other accused persons are said to have intruded into the house of the informant in the night armed with weapons and co-accused Mukesh Das tried to insult her while at the instigation of the petitioner other accused persons assaulted the informant and her husband and the petitioner took away Rs.5000/- of the informant.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner

happens to be gotiya of the informant and there is land dispute between the parties. Moreover petitioner has filed an informatory petition before the S.P., Banka on 27.06.2018 regarding extending threatening by the husband of the informant to the petitioner and being peeved up with the same informant has filed this false and frivolous case against the petitioner. No one has sustained any injury in the occurrence. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Banka (Barahat) P.S. Case No. 744 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
