Petitioner, in the present case, is seeking anticipatory bail in connection with Jainagar P.S. Case No.539 of 2018 registered for the offence punishable under Sections 272, 273 and 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has been made accused in the present case on the basis of the disclosure made by one of the apprehended accused Vikas Kumar. It is alleged that the said Vikas Kumar had disclosed that this petitioner was also working as carrier of the illicit liquor and he was using his motorcycle for the said purpose. motorcycle was seized. Learned counsel submits that in the orchard when the raid was conducted and some of the persons sitting there were arrested by police only one motorcycle was there which did not belong to this petitioner. It is submitted that there is no allegation that the motorcycle is a stolen property. Further that the petitioner has got no criminal antecedent.

Learned APP for the State is present and has though read out the case diary, but is unable to show any material from the same to support the allegations.

In the given facts and circumstances of the case where the name of this petitioner has transpired in the confessional statement but save and except that there is no other material to support the allegation, let the petitioner above named, in case of his arrest or surrender within four weeks from today in connection with Jainagar P.S. Case No.539 of 2018, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge (Excise), Madhubani, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
