2 22-04-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Lakhisarai P.S. Case No. 712/2018, instituted for offences under Section(s) 25(1-b)a, 26(i)(ii), 35 of Arms Act and Sections 30(a), 32(b), 38(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It is alleged in the written report that on getting secret informant police reached at the place of occurrence and recovered 76.170 litres of foreign liquor along with several firearms from the poultry farm of one Vijay Mandal.

Learned counsel for the petitioner has submitted that nothing has been recovered from conscious possession of this petitioner. He has been dragged in this case merely on suspicion.

Petitioner is in custody since 30.11.2018.

Considering the aforesaid facts and circumstances,

prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2^nd Addl. District & Sessions Judge-cum-Special Judge, Excise, Lakhisarai, in connection with Lakhisarai P.S. Case No. 712/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
