The petitioners seek bail in connection with Special Case No. 1855 of 2019 arising out of Rail Patna Jn. P.S. Case No. 65 of 2019 registered under Sections 273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The accusation is that on seeing the police party, both the petitioners started to move in fast speed but both were apprehended and 15 liters country made foreign liquors was recovered from each possession.

petitioners submits that petitioner no. 1 has no criminal antecedent while petitioner no. 2 is an accused in Spl. P.S. Case No. 7004 of 2017 arising out of Danapur Rail P.S. Case No. 102 of 2017 in which he is on bail. Both petitioners are in custody since 18.02.2019.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Rail Patna Jn. P.S. Case No. 65 of 2019.
