4 25-03-2019 The petitioner apprehends his arrest in connection with Complaint Case No. 1631(C) of 2016 registered under Sections 498A and 494 of the Indian penal Code.

Allegation against the petitioner is that he solemnised second marriage with the complainant and thereafter ousted her from the house.

Submission of learned counsel for the petitioner is that petitioner has already married with another lady and he has not solemnised marriage with the complainant and he has falsely been implicated in this case.

Heard learned APP also as well as learned counsel for the complainant. They have opposed the prayer for anticipatory bail

however, submitted that complainant is a widow and she has a daughter from that marriage and now she has been ousted from the house.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Complaint Case No. 1631(C) of 2016; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
