4 17-05-2019 This application, for grant of anticipatory bail, arises out of Aanti P.S. Case No. 19 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 325, 427, 307, 302, 504 and 506 of the Indian Penal Code.

Allegation against petitioner no. 1 is of assault to the deceased and allegation against petitioner no. 2 is of assault to Sunita Devi.

Submission of learned counsel for the petitioners is that they have falsely been roped in the present case and though there is allegation against petitioner no. 2 of assaulting Sunita Devi, however, no injury was found on her person and the occurrence took place due to family dispute between the parties.

Having heard both sides, considering the facts and circumstances, so far petitioner no. 2 is concerned, in the event of his arrest or surrender before the court below within six weeks, he is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Aanti P.S. Case No. 19 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

So far petitioner no. 1 is concerned, I am not inclined to grant him the privilege of anticipatory bail. He, if so desire may move before the court below for grant of regular bail, which will be disposed of by the court below on the merit of the case.

This application is, accordingly, disposed of.
