2 06-03-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with Samho P.S. Case No. 44 of 2018, registered for the offence punishable under Sections 25 (1-b) A, 26 of the Arms Act.

Learned counsel for the petitioner submits that in the instant case allegation is recovery of country made pistol with two live cartridges from the possession of the petitioner. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and he is in custody since 08.11.2018.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for nearly four

months, let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub- Divisional Judicial Magistrate, Begusarai, District- Begusarai in connection with Samho P.S. Case No. 44 of 2018.
