Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 304(B), 120(B)/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Petitioner is in custody since 07.05.2018. There is allegation of demand of dowry and torture for the same soon before death.

Submission of learned counsel for the petitioner is that marriage was solemnized seven years back. The victim was mother of two children and entire allegation has been leveled only after death of the wife of the petitioner.

available on the record fact, let the petitioner, above named, be released on bail after framing of charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Special Trial No. 303 of 2018 arising out of Darihat P.S. Case No. 47 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
