Heard learned counsel for the appellant as well as
learned APP.
In pursuance of direction, supplementary affidavit has been filed on behalf of the appellant.
It is needless to say that appellant happens to be under custody since 01.08.2017. Under Section 25(1-B) (a) of the Arms Act, he has been sentenced to undergo RI for two years and ten months as well as to pay fine of Rs. 8000/- in default thereof to undergo SI for six months additionally, under Section 26(1) of the Arms Act sentenced to undergo RI for one year as well as to pay fine of Rs. 2000/- in default thereof, to undergo SI for three months, with a further direction to run the sentences concurrently.
On account of carrying criminal antecedents, as has

been detailed under para-3 of the supplementary affidavit and further, it is also evident that appellant has got some sort of unwarranted activity in the background of having his absence relating to Saraiya PS Case No. 196/2011 for such a long period, that his attendance has been procured on 19.09.2017, the learned appellate court is directed to take up Cr. Appeal No. 46/2018 on priority basis and will decide the appeal by 30th of September 2019 positively, and will furnish a report to that effect.
In terms thereof, instant appeal is disposed of.
