This appeal arises from a judgment and order dated 13.02.2015 passed by the learned Single Judge of this Court in CWJC No. 5994/2008, whereby the writ petition was disposed of with liberty to the petitioners to pursue the suits so filed by them for declaration of their right and title over the land in question arising from Title Suit No. 61/2006 and Title Suit No. 64/2006 pending before the Munsif Naugachia in the District of

Bhagalpur and at the same time liberty was granted to the writ petitioners to assail the order passed by the statutory authority in Land Settlement Case No. 11/2007-08 which goes on to settle the land in dispute in favour of the private respondents, in the suit.

When this matter is taken up for final consideration and disposal Mr. Binod Kumar Singh, learned Counsel appearing for the appellant-petitioners after seeking instructions and while informing that the private respondents have been settled some other land and thus the order so put to challenge in the writ proceeding does not prejudice the appellants any more, chooses not to press the appeal, which is accordingly dismissed as not pressed.
