The allegation in brief is that all the accused persons came along with this petitioner armed with lathi and danda and two accused persons namely Jag Narayan Yadav and Santosh Yadav armed with gun opened firing causing injury to five persons.
Learned Counsel for the petitioner submits that there is enmity between both sides and there is dispute with regard to irrigation of the land. No specific overt has been alleged against the petitioner, he is said to be armed with lathi and danda and injuries on the victim are of fire arms attributed to Jag Narayan Yadav and Santosh Yadav. The petitioner has clean antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Lal Bahadur Singh @ Lal Bahadur Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM V Bhojpur, Ara in connection with Pawana PS Case No. 44 of 2017.
