2 19-12-2018 Heard the learned counsel for the parties.

This application for anticipatory bail arises out of Chanan P.S. Case No.75 of 2018, disclosing offences under Sections 120B,427,438 of the Indian Penal Code and Sections 16/17/128/20/23 of the U.A.P. Act.

From the First Information Report, it transpires that the petitioner has been named in the F.I.R along with other coaccused persons, on the ground of suspicion raised by the Chowkidar of the village in question, according to which the petitioner had conspired with others to set two trucks on fire for recovery of levy from the people of the area by terrorizing them.

Be that as it may, since the accusation is based on suspicion only, a case for grant of anticipatory bail is made out.

This application is allowed.

Let the petitioner above-named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Lakhisarai in Chanan P.S. Case No.75 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
