Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 17.2.2017 passed in Cr. Misc. No.6980 of 2017 with an observation that the learned trial court shall expedite the trial and conclude it within a period of six months and if it is not concluded within the said period, the petitioner may renew his prayer for bail.

Submission of the learned counsel for the petitioner is that statement which has been recorded in the court below shows that no specific overtact has been mentioned against this petitioner and he is in custody for 26 months.

Having heard both sides and perused the report. From perusal of the report, it appears that the learned trial court has stated that he will conclude the trial within a period of 2-3 months, as such I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of three months from the date of order and if the trial is not concluded in spite of co-operate of the defence, the learned trial court shall release the petitioner on bail on his own satisfaction.

With the aforesaid observation, this application is disposed of.
