Petitioners seek bail in Vaishali Belsar P.S. Case No.199 of 2016 registered under Section 364 of the I.P.C. corresponding to Sessions Trial No.63 of 2017.

The learned counsel for the petitioners submits that the

prayer for bail of the petitioner was earlier rejected vide order dated 16.01.2017 passed in Cr. Misc. No.46686 of 2016. A direction was given to the trial court to conclude the trial within nine months but the trial has not yet been concluded. Four witnesses have already been examined but they became hostile. None of the prosecution witnesses support the case of the prosecution. A report was called for. The learned Sessions Judge, Vaishali reported that out of 5 witnesses, 4 witnesses have already been examined and only I.O. is to be examined. The next date was 20.12.2017.

Since the trial is at fag end, I am not inclined to enlarge the petitioners on bail and the same is rejected. The trial court is directed to conclude the trial within two months from the date of receipt of this order. If the trial is not concluded within two months, the petitioners may renew his prayer for bail.
