The petitioners apprehend their arrest in Simari P.S. Case No. 240 of 2017 registered under Sections 147, 148, 149, 341, 342, 337, 307, 353, 427 and 504 of the Indian Penal Code.

The S.H.O. of Simari Police Station alleged that an accident took place near Kauleshwar Brahm Asthan situated in Sahiyar Village on 11.09.2017. When the police went there, 300-400 persons started pelting stones at the police party and caused damage to the police vehicle.

Learned counsel for the petitioners submits that the petitioners are, of course, named in the F.I.R., but no specific allegation is made against the petitioners. The family member

of the petitioners was killed in accident. Similarly situated coaccused Raju Thakur and others have already been granted anticipatory bail vide order dated 13.12.2017 passed in Criminal Miscellaneous No. 59615 of 2017.

Considering the facts, aforesaid, the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Simari P.S. Case No. 240 of 2017 to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Buxar or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
