The petitioners seek pre-arrest bail in connection with Narpatganj (Gurna) P.S.Case No. 483 of 2017 registered under Sections 341, 323, 324, 325, 379, 448, 354, 504 and 506/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that the informant is close agnate of the petitioners and on account of trivial issue between the children of two families, members of both sides fought with each other without there being any intention to outrage the modesty or to commit theft or to cause any grievous injury, but the police in order to make the offence

grave instituted the case under Sections 325, 379 and 354 of the Indian Penal Code. He submitted that the informant had sustained only simple and superficial injuries in the alleged incident.

Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioners.

Regard being had to the submissions made above, the petitioners, who are said to have no criminal antecedent, are directed to be released on bail, in the event of arrest or surrender before the court below within four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj (Ghurna) P.S.Case No. 483 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
