2 05-09-2018 Heard learned counsel for the petitioner and the State. Prayer for bail of the petitioner was earlier rejected vide order dated 09.08.2017 passed in Cr. Misc. 37874 of 2017.

Counsel for the petitioner submits that petitioner is in custody since 05.01.2017. He further submits that only charge has been framed in this case.

The Sessions Judge has mentioned in the impugned order that charge has been framed in this case and summons have been issued against the witnesses.

Keeping in view the period of custody of the petitioner and there is no chance of early disposal of the case by the trial court as appears from impugned order, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released

on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.II-cum-Special Judge, Excise Act, Gopalganj, in connection with Kuchaikote P.S. Case No. 4 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.

The petitioner in any manner will not try to hamper the trial by intimidating or influencing the witnesses and will remain present on each and every date of trial. Any two subsequent defaults without any valid reason will result in cancellation of bail bonds in the court below.
