The petitioner is in custody since 24.12.2017, in connection with Barauni P.S. Case No. 529 of 2002, for the offence registered under Sections 447, 386, 506/34 of the I.P.C.

Learned counsel for the petitioner submits that he is in custody for misusing the privilege of bail which was earlier granted to him by this Court vide order dated 22.05.2005 in Cr. Misc. No. 2585 of 2005.

Learned counsel for the petitioner further submits that petitioner's advocate could not make adequate pairvi in this case and, the petitioner was declared an absconder vide order dated 21.07.2016 and his bail bonds were cancelled and the petitioner has been arrested for misuse of the privilege of bail.

Learned counsel for the petitioner submits that the said laches on the part of the petitioner is not deliberate and he undertakes to participate in the trial on day-to-day basis as shall be fixed by the concerned trial court.

In view of the aforementioned submissions and the reason assigned in the present bail application of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 529 of 2002, subject to the following conditions:-

(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in Court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons his bail bonds shall be liable to be cancelled by the learned Court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself

available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
