The sole petitioner, who is in custody since 24.12.2017 in Bisfi P.S. Case No.312 of 2017 registered for the offence under Sections 401, 411, 413, 414, 467, 468/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned Senior Counsel appearing on behalf of the petitioner that the petitioner has been victimised due to the reason that he was pillion rider of motorcycle, which was being driven by an accused, who had stolen the motorcycle and from whose house, one another stolen motorcycle was receovered. He submits that save and except the fact that the

petitioner was a pillion rider, there is no other material against the petitioner and he is in languishing in custody without any proper trial. He submits that till date charge has not been framed.
Considering the nature of accusation as well as period of custody, let the petitioner, namely, Ram Awtar Yadav be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Benipatti in connection with Bisfi P.S. Case No.312 of 2017.
