Heard learned Counsel for the petitioners and the learned Counsel for the State.

Petitioners, already in custody since 11.3.2018, seeks bail in Khagaria PS Case No. 73 of 2018, registered under Sections 341, 323, 504, 342, 447, 307 and 326/34 of the IPC.

Learned Counsel for the petitioners submits that the quarrel took place on trivial issue of pelting brick bats in the house, there is case and counter case between both sides; there is general and omnibus allegation against all the three petitioners of assaulting the informant by lathi over his head but only one injury has been found on his head on the front portion, the allegation of throwing acid is not against these petitioners rather the same is against Phulmati Devi and these petitioners bear no criminal antecedent.

Having considered the said facts and circumstances, the petitioners namely Suresh Sah, Pawan Sah and Pritam Sah are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Khagaria in connection with Khagaria PS Case No. 73 of 2018.
