Heard learned counsel for the petitioner and the

learned APP for the State.

Petitioner, already in custody, seeks bail in connection with Katihar Town PS Case No.712 of 2016, registered under Sections 326, 307 and 302 of the Indian Penal Code.

Allegation in brief is that on the occasion of procession of Muharram , the lathi of the son of the informant hit Md. Alimuddin, father of the petitioner who exhorted to kill then the petitioner opened revolver and shot at him causing firearm injury and died subsequently during treatment on 01.11.2016.

Learned counsel for the petitioner submits that the falsity of the accusation is apparent from the fact that the

occurrence is said to be dated 13.10.2016 in presence of so many people, even police personnel are deputed on the occasion of procession of Muharram but the FIR is lodged after lapse of 19 days precisely on 01.11.2016 and there is no explanation for such delay.

Having considered the aforesaid facts and circumstances, petitioner Md. Azimuddin Ansari @ Md. Guddu Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Katihar Town PS Case No.712 of 2016 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to the cancelled.
