Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A, 34 of the Indian Penal Code.

According to FIR, the petitioner allegedly kidnapped to the sister of the informant. The victim girl in her statement under Section 164 Cr.P.C. stated that she had love affairs with the petitioner. Thereafter, she wanted to go with the petitioner and subsequently she married with the petitioner. She further stated that she wants to live with the petitioner and not alongwith her parents.

prayer for bail on the ground that subsequently offence under Section 376 I.P.C. and offence of the POCSO Act has also been added in the FIR. Hence, perusal of the case diary would be necessary.

Considering the statement of the victim girl, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Civil Lines Police Station Case No.431 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
