Heard learned counsel for the petitioner and the

learned APP for the State.

Petitioner, already in custody, seeks bail in connection with Ramgharwa P.S. Case No.001 of 2018, registered under Sections 25(1-b)a/26 of the Arms Act.

It is submitted that the police always used to falsely implicate the petitioner, in fact nothing was recovered from his possession; whereas the learned counsel for the State submits that there is recovery of one loaded country made pistol and three live cartridges and this petitioner has chequered criminal history as there are 22 cases including several cases of Arms Act and other serious offences against him.

Having considered the aforesaid facts and

circumstances, the prayer of bail of the petitioner is rejected in connection with Ramgharwa P.S. Case No.001 of 2018 pending in the court of learned CJM, East Champaran at Motihari.

However, the trial court is directed to expedite the trial and preferably conclude the same within six months.

If the trial does not conclude within the stipulated period, the petitioner may renew his prayer of bail.
