Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the informant.

Petitioners, already in custody, seek bail in Complaint Case No. 221C of 2010 registered under Sections 302, 328 and 120B of the IPC.

The allegation in brief is that the deceased along with the petitioners consumed toddy and it is suspected that the petitioners mixed poison in the toddy and as a result he died.

Learned Counsel for the petitioners submits that the police case was instituted in the year 1994, on completion of investigation the police did not find involvement of the petitioners and submitted final form as clue less and after approximately two decades on protest petition cognizance has been taken, the petitioners have no criminal antecedents and are in custody since 11.12.2017.

petitioner, namely, Md. Tajmul, Md. Ajamul @ Bilki @ Bulli, Md. Idrish @ Eddo @ Eddan and Md. Aausan @ Ausan are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Kumar, Judicial Magistrate, lst Class, Saharsa in connection with Complaint Case No. 221C of 2010.
