2 13-01-2017 The learned counsel, Mr. Anshuman, for the petitioner submitted that against the Judgment of the Session Judge in fact criminal revision and / or proceeding under Section 482 Cr.P.C. will be maintainable in view of the decisions of (i) (2011)12 SCC 588 (ii) (2016)11 SCC774 (iii) (2016)2 SCC 705 (iv) (2014) SCC Online Mumbai 1372 (v)(2012) SCC Online Delhi 3192. Therefore, he seeks permission to convert this Civil Misc. application to a proceeding under Section 482 Cr.P.C.
In view of his submission, his prayer is allowed. He is permitted to convert this Civil Misc. application to Cr. Misc. application under Section 482 within two weeks.
