The petitioner seeks bail in Excise case No. 37 of 2016 under Section 47(a) (f) of the Excise Act.
The petitioner Ozair Mian and Gaffar Mian are made accused for recovery of 260 liters of country made liquor, wrappers and bottles from a hut situated near the house of the petitioner.
The learned counsel for the petitioner submits that the hut does not belong to the petitioner. The petitioner has falsely been implicated in the case and he is in jail custody since 17.01.2017. The petitioner has already remained in jail for about two months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Excise case No. 37 of 2016.
