The petitioner, already in custody, seeks bail in connection with Maner P.S.Case No. 38 of 2017 registered under Sections 302/34 of the Indian penal Code and Sections 25(1-b)a/26/27 of the Arms Act.

Allegation in brief is that five named accused persons came to the house of the informant, called his son and taken away somewhere else and it is alleged that Jai Biru Ray, one of the coaccused shot upon him by pistol causing his death.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and the specific allegation of killing is against Jai Biru Ray and the only material against the petitioner is of disclosure of his name by Jai Biru Kumar regarding his participation and the petitioner has no criminal antecedent, except

one case of Excise Act and other similar situated co-accused Lallu Rai has been granted bail by a co-ordinate Bench of this Court vide order dated 12.12.2017 in Cr. Misc. No. 58254 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sugiya @ Mahendra Ray is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Danapur, Patna in connection with Maner P.S. Case No. 38 of 2017.
