The petitioner, already in custody, seeks bail in connection with Sour Bazar (Patarghat OP) P.S.Case No. 334 of 2016 registered under Sections 302, 304B and 201/34 of the Indian penal Code.

Allegation in brief is that all accused persons killing the daughter of the informant, who was married to the petitioner’s brother, threw her deadbody in the pond as demand of dowry was not fulfilled.

Learned counsel for the petitioner submits that marriage of the deceased was solemnized with the brother of the petitioner six years back and there is no specific allegation against this petitioner and husband is in custody and other similarly situated other coaccused Anmol Roy (father-in-law) was granted regular bail by a

co-ordinate bench of this Court and Mala Devi and Saroj Devi @ Sarita Devi (mother-in-law and Nanad) have been granted anticipatory bail by order dated 04.04.2017 and 17.10.2017 passed in Cr. Misc. No. 11712 of 2017 and Cr. Misc. No. 37288 of 2017 respectively, though the petitioner is in custody sicne 23.08.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Prabhash Roy @ Prabhat Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Sour Bazar (Patarghat OP) P.S. Case No. 334 of 2016.
